The Biden administration will reportedly lean on whistleblowers in an effort to enforce its new vaccine mandate for companies with more than 100 employees.
According to an Associated Press report, the Occupational Safety and Health Administration – or OSHA – which has been tasked with handling the vaccine mandate rule, doesn’t have enough safety inspectors to enforce the mandate.
Debbie Berkowitz, an adviser at OSHA during the Obama administration, laments that “there is no army of OSHA inspectors that is going to be knocking on employers door or even calling them.”
The mandate seeks to levy fines of up to $14,000 per serious violation and is set to take effect on January 4th.

Vaccine Mandate Enforcement Will Need Whistleblowers
A previous report by the Daily Mail indicated vaccine mandate enforcement would occur through inspectors.
“Enforcement of the rule,” according to an official on a background call with the outlet, “will be just as that of any other rule, which includes inspections to check for compliance.”
Berkowitz, however, feels there aren’t enough inspectors at OSHA to carry out such widespread enforcement needs.
“They’re going to rely on workers and their union representatives to file complaints where the company is totally flouting the law,” she said.
Jim Frederick, the acting chief of OSHA, seems to agree that whistleblower complaints will be necessary for the Biden administration to enforce the vaccine mandate.
Frederick said the agency will focus “where workers need assistance to have a safe and healthy workplace,” adding, “that typically comes through in the form of a complaint.”

Mandate Raises Constitutional Concerns
Berkowitz hinted that the vaccine mandate rule will be pretty weak if it relies on whistleblowers.
“You fill out a form or somebody fills out a form for you,” she said. “And that’s all workers have. If OSHA decides not to inspect, that’s it. Or if OSHA inspects but decides not to cite the employer, that’s it. … So it’s a pretty weak law.”
Realistically though, is OSHA under President Biden going to turn away any complaints involving COVID?

Frederick says OSHA will be ready to handle the whistleblower complaints.
“We will have our staff available and responsive to complaints, which is a number one way we hear about problems in a workplace,” he said.
Will they investigate complaints about the President’s unconstitutional actions?
Will they investigate complaints from those who feel the vaccine is unnecessary due to their natural immunity?
Will they investigate complaints of forced or coerced compliance?
The White House on Monday advised businesses to ignore a federal court’s temporary halt on the vaccine mandate, saying they should continue to abide by the order.
This, despite the fact that the federal court said the vaccine mandate raises “grave statutory and constitutional issues.”
