Long-serving liberal Supreme Court Justice Stephen Breyer reportedly plans to retire from the bench.
The leftwing judge, who is 83 years old, originally appointed by President Clinton in 1994, served for 27 years on the nation’s high court.
His resignation will hand President Joe Biden the opportunity to name his successor – which will likely be sent to a deadlocked 50-50 Senate, though Vice President Kamala Harris has the tie-breaking 51st vote.
The timing is curious, given the predictions of a red wave in 2022 that could tilt the Senate to the Republicans.

CNBC reports that leftwing activists have been urging Breyer to retire so that Biden could nominate a younger liberal who could serve on the court for many years to come.
It seems they have gotten their wish.
In 2021, Breyer argued against the demands of leftwing activists who wanted to expand the Supreme Court, saying, “Structural alteration motivated by the perception of political influence” would erode trust in the nation’s highest court.
Among Breyer’s more high-profile cases while on the Supreme Court, he wrote the majority opinion in Stenberg v. Carhart, while ruled that banning partial-birth abortion was unconstitutional.
Breyer graduated from Harvard Law School in the early 1960’s.
